1. Introduction and Acceptance of Terms

Welcome to our platform (the "Platform" or "Service"). These Terms of Service ("Terms") govern your access to and use of our marketplace, which connects local hosts ("Hosts") with tourists and visitors ("Tourists" or "Guests") seeking to experience local living spaces. By accessing or using the Platform, you agree to be bound by these Terms.

2. Nature of the Service: A Pure Marketplace

2.1. Platform Role: The Platform acts exclusively as a neutral online venue and marketplace that allows Hosts to list their residences for visits and Tourists to book such visits. We do not own, operate, manage, or control any of the properties listed on the Platform.

2.2. Not a Party to Agreements: Any agreement or transaction formed through the Platform is solely between the Host and the Tourist. We are not a party to any contract, agreement, or interaction between users. We act only as a facilitator for the connection and, where applicable, the processing of payments.

3. Limitation of Liability and Assumption of Risk

3.1. Complete Disclaimer of Liability: To the maximum extent permitted by law, the Platform, its founders, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages, or any loss of property, personal injury, distress, or death arising out of or in connection with a visit arranged through the Platform.

3.2. Assumption of Risk:Both Hosts and Tourists acknowledge that allowing strangers into a private residence, or visiting a stranger's private residence, carries inherent risks. Users assume all risk associated with these interactions. We do not conduct background checks, verify the identity of users, or inspect the safety, quality, or legality of any Host's residence.

3.3. No Endorsement: The listing of a Host or a property does not constitute an endorsement, warranty, or guarantee by the Platform regarding the safety, character, or suitability of the Host, the Tourist, or the premises.

4. User Responsibilities

4.1. Host Responsibilities

• Ensuring the residence is safe, legally permitted to be shown, and free of hazardous conditions.
• Securing all valuables and sensitive personal information prior to a visit.
• Maintaining adequate homeowners or renters insurance that covers third-party liability.

4.2. Tourist Responsibilities

• Treating the Host's property with respect and adhering to any house rules set by the Host.
• Refraining from unauthorized photography, recording, or theft.
• Being solely responsible for their own personal safety and belongings during the visit.

5. Indemnification

You agree to release, defend, indemnify, and hold harmless the Platform and its affiliates from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your interactions with any other user, your breach of these Terms, or your use of the Platform.

6. Dispute Resolution

Any disputes arising between a Host and a Tourist must be resolved directly between the parties. The Platform is under no obligation to mediate, assist, or resolve disputes between users regarding property damage, personal injury, unmet expectations, or any other issue occurring during a booked visit.
